Terms of Service

Funbooth Ltd Service Agreement

If you are hiring on behalf of a business or organisation you confirm that you have the necessary authority to enter into this contract on behalf of that business or organisation, and that you will indemnify us against all losses and expense which may be incurred if this is not the case.

Section 1 – Pricing & Payments

1.1 Prices

Prices and availability of products are subject to change without notice, however once a deposit payment has been paid the price quoted will not change without the customers consent. Any quotation given may change up until the deposit is paid to secure the booking.  Funbooth LTD accept no responsibility for price changes following initial quotations and subsequent bookings being confirmed.

There may be additional pricing requirements based on services selected – please see section 3 of this agreement for details

1.2 Initial Payment, Fees and Cancellation Charges

An initial deposit payment of 20% of your total booking fee is required to secure your booking. This can be paid automatically through our online booking system. The deposit you pay to secure your event is non-refundable 60 days leading up to the event and reflects the work we put into event organisation prior to attending, and the bookings we will have missed securing you date for you.

All cancellations must be made by contacting us. Once your event has been cancelled, your event date will immediately be available for other people to book.

  • Cancellation 61 days or more before the event – refund of the full amount of the initial payment and/or other monies paid.
  • Cancellation between 60-31 days of the event – refund of any monies paid, excluding the deposit
  • Cancellation within 30 days of the event – at this point, it is usually too late for us to get another booking, and so we have lost out. No refund processed.

If Funbooth LTD agree to a reschedule of your event, and move your booking accordingly, if you subsequently cancel the following terms apply:

  • Cancellation 61 days or more before the new event date – refund of the full amount of the initial payment and/or other monies paid.less a £15 administration fee (£10 for Bouncy Castle, Inflatable Dartboard, or Inflatable Ball Pit) for processing the reschedule.
  • Cancellation between 60-31 days of the event – refund of any monies paid, excluding the deposit 
  • Cancellation within 30 days of the event – no refund processed.

1.3 Full Payment

Full and final payment is required at least 30 days before your event. An invoice will be generated and e-mailed to you for secure online payment.

Section 2 – Venue, Access and Location

2.1 Customer responsibility

It is your responsibility to ensure you have provided the venues contact information, address, name, and postcode for our attendants to find you. We also require that the venue allows reasonable access for loading, and suitable parking once the equipment has been unloaded. If parking is restricted, you will be liable to any fines that occur as a result and/or time used seeking a suitable parking location. We cannot be held responsible for any errors or delays resulting from incorrect or missing address details.

There may be additional responsibility requirements based on services selected – please see section 3 of this agreement for details

2.2 Maintenance

You agree to properly maintain the equipment during the period of the hire and to notify us as soon as reasonably practicable if there is a problem with the operation of any item of equipment.

You shall not alter or modify the equipment or use it for purposes for which it is not designed.

You agree that we have a right of access to the equipment in order to inspect, repair or replace it and you authorise us to enter any property where the Equipment is located or where we reasonably believe it to be located, to carry out such inspection, repair or replacement.

Any breakdown or any unsatisfactory working of equipment must be immediately notified to us. Under no circumstances must you repair or attempt to repair the equipment unless authorised by us.

Any and all equipment provided remain the property of Funbooth LTD at all times. In the event of a breach of any of these Terms and Conditions, Funbooth LTD without prejudice to any other rights may terminate the contract and repossess all their equipment. Equipment is not to be hired, re-hired or sub-hired to any third parties.

The equipment provided will be in full and safe working order and in good physical condition. In the event of equipment being defective, Funbooth LTD provides a backup/out of hour’s service to repair/replace defective equipment at its discretion. Funbooth LTD will however make every reasonable effort to rectify the situation. In the extremely unlikely occurrence of a non-performance, or if a total failure occurs, you will be refunded in full. In this situation, this will be the full extent of our liability

2.3 Events beyond our Control

Funbooth LTD cannot be held responsible for any circumstances that may prevent us from attending your event; these may include but are not limited to, severe weather conditions, traffic delays, breakdown of our vehicles, sickness or equipment failure or any other event. In the case that we cannot attend or fulfil our hire due to events beyond our control we will contact you or the venue as soon as possible. Any act of force majeure including, but not limited to, civil emergency, epidemic, natural disaster, declaration of war, riot, energy blackout, strike or similar, terrorist attack or government intervention including unexpected legislation, will result in Funbooth LTD not being held liable for failure or delay in the performance of its obligations under the contract. It is at Funbooth LTD’s discretion as to whether a reschedule is offered. 

2.4 Set-up of Services

We will arrive to set up approximately 60 minutes before the hire period is due to commence. If you require set up earlier then please contact our team on 0800 023 6408.

It is your responsibility to ensure that the venue has agreed for us to be in attendance at their venue and at the agreed time. This also includes ensuring that there is sufficient access to the venue and enough space with a power socket within 5 metres of where the services are to be. If there is insufficient space for us to set-up you will still be charged the full hire amount.

You are responsible for checking that the Venue power sources are electrically safe and conform to the Health and Safety Executive Electricity At Work Regulations 1989 and amendments thereafter. Copies of Venue Electrical Installation Safety Certificate (Periodic Inspection Report to NIC EIC standards) must be made available upon request by the Venue under law.

It is your responsibility to inform us of any circumstances that may make setting up take longer. These may include but are not exhaustive to; going upstairs, a long distance from unloading area to set-up area, restricted access. If we are not aware of these and the set-up takes longer than normal, your hire period may be intruded upon.

There may be additional set-up requirements based on services selected – please see section 3 of this agreement for details.

2.5 Hire Period

The hire period will be for a set period, as specified in the booking form and as agreed by both parties before. In addition, this will cover the 60-minute setup time and a 45 minute pack down time. Use will commence at the agreed time and finish at the agreed time in the booking form unless due to technical difficulties on our behalf, when we provide the service for the set period once rectified.

If your event simply starts late, or runs late, our period of hire will still be for the agreed period and times unless we agree to provide additional hours.

There may be additional hire period requirements based on services selected – please see section 3 of this agreement for details.

3 Services

Please find details here of any terms and conditions relating directly to services that you have selected.

Lit Letters

Any cosmetic damage to the letter lights will be charged accordingly. 

Drinks, glasses, food and any other items that can cause marks, scrapes and scuffs must not be placed on the letter lights.  This is your responsibility.  If you see a glass (empty or full) please move it.  If liquid gets down the back of the lights this will no doubt short out the electrical circuit and you will be liable for new wiring.

These lights are for indoor use only. In the event that the lights are used outside (not under cover e.g. a marquee) additional charges will apply, and the lights are only to be used outside with the prior agreement of Funbooth LTD.

You are responsible for the lights during the hire agreement; they must be ready for collection in the same state that they were delivered in.

Once the lights are set-up, they should not be moved unless agreed beforehand.  Funbooth LTD do not accept any liability for injury caused due to moving lit letters after set-up.

Although the lights use safe LED bulbs, no one is to touch the light caps.

The lights should be placed against a wall, with no access behind them.

Children should be supervised at all times near the lights. Again, although they use safe LED lights, they are large items and heavy if they fall on someone. 

Lit Numbers

Any cosmetic damage to the number lights will be charged accordingly.

Balloon Garlands

These are only provided if booked as an extra add on to the Lit Numbers. 

We use removable command hooks against most commonly glass window or plaster wall, which can be easily removed by pulling the adhesive tab downwards. Please make sure you do this slowly so that the tab comes off in one piece, as improper removal may cause damage to your wall such as paint peeling etc. No liability will be taken should this happen.

It is your responsibility to get approval from the venue manager to use command hooks. No liability will be taken should the hooks cause damage to the surface they were stuck on.

If hooks were not allowed and there are no other rigging options available (such as ceiling beams etc), then you will need to hire a backdrop.

If we are fixing your garland to a backdrop, the backdrop must be ready at the designated set up time. We are always under tight schedule and will only have a limited amount of time on site (up to an hour in most cases). If the prop is not ready when we get there, unfortunately we will have to install the garland temporarily elsewhere which you can move later on.

We do not remove the balloons upon collection unless agreed beforehand. Do with the balloons what you wish; onsell them, give to children to play with, etc.

It goes without saying that with balloons, their lifetime is affected by the condition they are in. If you keep them indoor with no direct sunlight, air conditioning, or heating running in the room, they will last up to a few weeks or a month. 

When balloons are oxidised, they will loose their natural shine and become matte and dull in appearance, confetti balloons will become cloudy. Balloons will also shrink faster on a cold winter night or in a room with air conditioning.

With outdoor installation, balloons may oxidise as quickly as half an hour. Some balloons may pop randomly on a really hot day. Generally you can only assume outdoor garland to last for the day.

Given the organic nature of garlands, no two garland can be made exactly the same. The colours and composition will be the same (or a close match), however the shape or the end result will never be identical to your inspiration photo. Please note that your garlands may appear shorter or longer due to its natural curves.

We prepare your balloon order as soon as you put down a deposit (stock ordered, etc) so refund is strictly not available once you have paid in full. Strictly no changes are permitted within 24 hours of installation date, whether it be event location, colour scheme or composition, or set up time.

Candy Floss

Be advised that some food machines involve cooking on site which will produce heat. Funbooth LTD advises to locate these machines in well-ventilated rooms with high ceilings so as not to affect any smoke alarms. Funbooth LTD cannot be responsible for any smoke alarm / fire alarm going off at the venue and affecting the event and any or items on site (evacuation, time delay, sprinkler system, etc). Upon hire of these machines and selecting the location on site you are responsible for this action. Contact Funbooth LTD in advance if you have any concerns over this prior to the event.

You are solely responsible for any claim for any spillages on any items of clothing, furniture, carpet or anything else caused by others.

Whilst Funbooth LTD make every effort to obtain your first choice of flavours if for any reason Funbooth LTD are unable to fulfil your choice due to supply not been available, we will substitute with another choice available.

We recognise the seriousness of allergic reactions;

As the making of most foods may involve the same product line for products with or without nuts, we are unable to guarantee 100% that traces of nuts will not be present in ANY foods .

Please note that the foods may also contain gluten, milk, eggs, wheat, and/or coconut. Please also take this into consideration.

We recommend that young children are supervised by an adult with all food items hired.

It is your responsibility to inform us of the correct amount of guests; if there are more guests than stated, your booking time will be significantly reduced as items will run out. 

Popcorn

Be advised that some food machines involve cooking on site which will produce heat. Sweet Cart 

Funbooth LTD’s sweet cart is professionally made and painted; you are not permitted to stand drinks on the carts as this may result in staining and water damage. Any damage to the sweet carts caused by drinks or glasses will incur a charge. Missing items or damaged items will be charged at the full replacement value, we will not accept any substitute replacements. You are not allowed to attach your own decoration to the sweet cart.

You are solely responsible for any claim for any spillages on any items of clothing, furniture, carpet or anything else caused by others.

Whilst Funbooth LTD make every effort to obtain your first choice of flavours if for any reason Funbooth LTD are unable to fulfil your choice due to supply not been available, we will substitute with another choice available.

We recognise the seriousness of allergic reactions;

As the making of most foods may involve the same product line for products with or without nuts, we are unable to guarantee 100% that traces of nuts will not be present in ANY foods .

Please note that the foods may also contain gluten, milk, eggs, wheat, and/or coconut. Please also take this into consideration.

You are not allowed to add your own sweets to those provided as part of a package; this is for insurance and traceability purposes. If it is subsequently found that you have added your own sweets, you are notified that all possible future claims against our public liability insurance are voided.

We recommend that young children are supervised by an adult with all food items hired.

It is your responsibility to inform us of the correct amount of guests; if there are more guests than stated, your booking will be significantly reduced as items will run out. 

Treat Hearts

The Treat Hearts are only to be used as intended, with wrapped sweets. Using unwrapped sweets or food items may result in staining. Any damage to the Treat Hearts caused by this will incur a charge. Missing items or damaged items will be charged at the full replacement value, we will not accept any substitute replacements.

You are solely responsible for any claim for any spillages on any items of clothing, furniture, carpet or anything else caused by others.

Whilst Funbooth LTD make every effort to obtain your first choice of flavours if for any reason Funbooth LTD are unable to fulfil your choice due to supply not been available, we will substitute with another choice available.

We recognise the seriousness of allergic reactions;

As the making of most foods may involve the same product line for products with or without nuts, we are unable to guarantee 100% that traces of nuts will not be present in ANY foods .

Please note that the foods may also contain gluten, milk, eggs, wheat, and/or coconut. Please also take this into consideration.

We recommend that young children are supervised by an adult with all food items hired.

It is your responsibility to inform us of the correct number of guests; if there are more guests than stated, your booking time will be significantly reduced as items will run out. 

Crisp & Snack Wall

The Crisp & Snack wall are only to be used as intended. Funbooth LTD will set up the item with the number of packets agreed upon in the booking. Failure to plan for the correct number of guests will result in the packets running out quicker than anticipated; this is not the fault of Funbooth LTD.

Once in place, the Crisp & Snack wall is not to be moved by anyone other than a Funbooth LTD employee.

Any damage to the Crisp and Snack wall this will incur a charge.

You are solely responsible for any claim for any spillages on any items of clothing, furniture, carpet or anything else caused by others.

Whilst Funbooth LTD make every effort to obtain your first choice of flavours if for any reason Funbooth LTD are unable to fulfil your choice due to supply not been available, we will substitute with another choice available. Your package is for the complete number of packets advised. Any leftover at the point of collection will be left at the venue for you. There are no refunds for leftover packets not used during the hire period.

It is important to note that, subject to wholesale availability, the crisps and snack packets provided may be price-marked or have promotional packaging/offers. This is purely dependent on what is available at the time of purchase and will not result in a refund of any money paid if the packets do not look as you expect them too.

Starlit Backdrop

It is your responsibility to provide adequate space at the venue to set up the Starlit Backdrop(s). This means an adequate amount of floor space to lay out the poles, and clear access to the space where the backdrop will be on display.

Any cosmetic damage to the backdrop(s) will be charged accordingly. 

These backdrop(s) are for indoor use only. In the event that the starlit backdrop(s) are used outside (not under cover e.g. a marquee) additional charges will apply, and the backdrops are only to be used outside with the prior agreement of Funbooth LTD.

You are responsible for the backdrops during the hire agreement; they must be ready for collection in the same state that they were delivered in.

Once the backdrops are set-up, they should not be moved unless agreed beforehand.  Funbooth LTD do not accept any liability for injury caused due to moving backdrops after set-up.

Although the backdrops use safe LED bulbs, no one is to touch the lights. 

The backdrops should be placed against a wall, with no access behind them.

Children should be supervised at all times near the backdrops. They are delicate. 

Starlit LED Table Skirts

Any cosmetic damage to the Starlit LED Table Skirts will be charged accordingly. 

These table skirts are for indoor use only. 

You are responsible for the table skirts during the hire agreement; they must be ready for collection in the same state that they were delivered in.

Once the table skirts are set-up, they should not be moved unless agreed beforehand.  Funbooth LTD do not accept any liability for injury caused due to moving the table skirts after set-up.

On collection of the items hired, it is not our responsibility to clean your venue following your event. If Funbooth LTD need to move items to do this, we will endeavour to do so carefully but accept no liability or responsibility for anything else being damaged at your event upon us collecting our equipment.

Although the table skirts use safe LED bulbs, no one is to touch the lights. 

Children should be supervised at all times near the table skirts. . They are delicate

Chair Covers & Sashes

It is up to you to ensure you have hired enough chair covers, and/or sashes for the number of tables/chairs you need for your event.

Although Chair Covers & Sashes may be returned soiled, any permanent stains or damage, pulls in the fabric and burns etc will attract a replacement charge for each damaged item.

A charge of £10.00 will be made for each chair cover or tablecloth which is returned in an unusable condition.

A charge of £2.00 will be made for each chair sash which is returned in an unusable condition.

On collection of the items hired, it is not our responsibility to clean your venue following your event. Chair covers must be easily accessible for collection. If Funbooth LTD need to move items to do this, we will endeavour to do so carefully but accept no liability or responsibility for anything else being damaged at your event upon us collecting our equipment.

When hiring chair covers it is your responsibility to ensure the covers fit your venues chairs prior to our arrival.  Funbooth LTD will supply you with a sample where necessary to check this.

 Table Linen

It is up to you to ensure you have hired enough linens/tablecloths  for the number of tables you need for your event.

Although Table Linen may be returned soiled, any permanent stains or damage, pulls in the fabric and burns etc will attract a replacement charge for each damaged item.

A charge of £10.00 will be made for each tablecloth which is returned in an unusable condition.

On collection of the items hired, it is not our responsibility to clean your venue following your event. Table linens must be easily accessible for collection. If Funbooth LTD need to move items to do this, we will endeavour to do so carefully but accept no liability or responsibility for anything else being damaged at your event upon us collecting our equipment.

Table linens must not be used outside.

Table Runners

It is up to you to ensure you have hired enough Table Runners that you need for your event.

Although Table Runners may be returned soiled, any permanent stains or damage, pulls in the fabric and burns etc will attract a replacement charge for each damaged item.

A charge of £5.00 will be made for each Table Runner which is returned in an unusable condition

On collection of the items hired, it is not our responsibility to clean your venue following your event. Table Runners must be easily accessible for collection. If Funbooth LTD need to move items to do this, we will endeavour to do so carefully but accept no liability or responsibility for anything else being damaged at your event upon us collecting our equipment.

Table Runners must not be used outside.

LED Starlit Dancefloor

It is your responsibility to provide adequate space at the venue to set up the LED Starlit Dancefloor. This means an adequate amount of floor space to lay out the pieces.

No food or drinks of any kind are permitted on the dance floor. Any liquid spillages must be mopped up immediately, as they will cause serious damage if absorbed into the floors. You are responsible for ensuring your DJ on the evening makes regular announcements to prevent such damage.

Any cosmetic damage to the dancefloor will be charged accordingly. 

The dancefloor is for indoor use only.

You are responsible for the dancefloor during the hire agreement; it must be ready for collection in the same state that it was delivered in.

Once the dancefloor is set-up, it should not be moved under any circumstances. Funbooth LTD do not accept any liability for injury caused due to moving the dancefloor after set-up.

It is your responsibility to inform Funbooth LTD if there are any access restrictions at the venue; high steps, steep hills, no lift access etc. Failure to do so may result in the dance floor not being able to be used at the venue. If this occurs there will be no refund.

Glitter Bar

Funbooth LTD requires parental consent for any face painting or glitter application being carried out on a person under the age of 18, and a parent must accompany all minors.

Funbooth LTD only use professional water-based face paints and cosmetic glitter which are fully compliant with EU and FDA toy and cosmetic regulations. These paints are hypoallergenic and include anti-bacterial properties which are specifically for use on the face and skin. Paint can easily be removed using mild soap and water. Some skin types are prone to some very mild initial staining – a small amount of mild baby shampoo will remove this gently.

Water is changed regularly during a booking. All equipment is thoroughly cleaned after each booking.

The face painter/artist provided by Funbooth LTD may be able to work longer but this is at the discretion of the face painter/artist. Please be aware the face painter/artist may have additional bookings to go to.

Funbooth LTD Artists can paint around 12 quality full faces an hour but please do not expect the artist to stay longer.

The face painter/artist will start working at the time stated and leave at time stated. A setting up period and packing away period will be allowed for by the face painter/artist.

You agree to pay for any accidents or injuries caused by you, your guests and/or pets, and/or any damage to artist’s equipment or supplies caused by you, your guests and/or pets.

Face painting is not available for under 3’s. Face paint manufacturers do not recommend paint for anyone below this age and very young children can sometimes be overwhelmed by the results. We may paint a small design on hands or arms of children younger than 3 years of age but this will be at the discretion of the face painter.

Funbooth LTD will not paint anyone who is obviously unwell (runny nose/temperature/rash) or has any other visible skin complaint (eczema; chicken pox; acne; cold sore; open wounds; eye infections etc).

Funbooth LTD will not paint anyone against their wishes (this may result in stopping painting before the final result if a child becomes uncomfortable or changes their mind).

Children must be under constant adult supervision whilst being painted or waiting their turn.

If you believe the person to be painted has sensitive skin, a skin patch test can be carried out. It is the guardian’s responsibility to inform the face painter in advance if this is the case. Funbooth LTD will not be held liable for any allergic reaction to the paint.

Face Paint

Vintage Post Box

Our vintage post box comes with 1 set of keys. Funbooth LTD retain a second set of keys at all times.

At time of collection, it is important that the postbox be emptied, and keys put inside the box. Funbooth LTD accept no liability if, at time of collection, the post box has not been emptied and subsequently, upon emptying, items go missing. We will always endeavour to give items to the host and/or client, however where this is not possible we will leave the items present with the venue. 

Funbooth LTD shall make our best efforts to supply you with the goods requested, but we reserve the right to supply you with similar goods.

On collection of the items hired, it is not our responsibility to clean your venue following your event. All hired items must be easily accessible for collection. If Funbooth LTD need to move items to do this, we will endeavour to do so carefully but accept no liability or responsibility for anything else being damaged at your event upon us collecting our equipment.

Audio, Video, Projection, PA Hire

All equipment will be delivered, set-up and collected by the sound engineer allocated to your job. We will have a sound engineer on site until the sound checks have been completed.

It is your responsibility to provide adequate space at the venue to set up the audio/video/projection or PA hire equipment. This means an adequate amount of floor space to lay out the pieces.

The space provided must allow a safe electrical supply, and limit thoroughfare to the equipment.

Any damage to the Audio, Video, Projection, or PA equipment will be charged accordingly. 

Audio, Video, Projection, or PA equipment may only be used outside with express permission of Funbooth LTD.

You are responsible for the equipment during the hire agreement; it must be ready for collection in the same state that it was delivered in.

Once the equipment is set-up, it should not be moved under any circumstances. Funbooth LTD do not accept any liability for injury caused due to moving the equipment after set-up.

It is your responsibility to inform Funbooth LTD if there are any access restrictions at the venue; high steps, steep hills, no lift access etc. Failure to do so may result in the equipment not being able to be used at the venue. If this occurs there will be no refund. 

Venue Décor

No real flames, real candles or otherwise naked flame is to be used in, on or near any item hired from Funbooth LTD. Fake, real-look candles can be hired from Funbooth LTD if required.

Foam/Snow Machines

Outdoor use of the foam and/or snow machine is only allowed after express permission being granted directly by Funbooth LTD.

Once set up, Funbooth LTD do not recommend moving the machines HOWEVER if you need to;

  • Turn off the machine
  • Turn off the power
  • Unplug the machine
  • Move carefully – there may be liquid still inside
  • Ensure machine is set on a level surface
  • Plug machine back in – ensure there is suitable slack in any power lead and that it is not in any area whereby someone could trip over the lead. We recommend taping the lead to the ground.
  • Turn the power back on
  • Turn the machine back on

Funbooth LTD do not accept any liability for injury caused due to moving machines after set-up. Any spillages will need to be cleaned immediately to avoid risk of slipping. 

By hiring this item this is your acceptance that you have specific permission from the venue representatives to use the item on their premises.They must be aware that the foam/snow machine may cause damage in the same way that water would. 

Children are NOT to touch the machines. It is recommended that all children are supervised in the presence of the foam/snow machines. 

Unless agreed beforehand, additional liquid for the foam/snow machine will NOT be provided. It is your responsibility to ensure you have hired enough and use it wisely during your event.

Funbooth LTD do not accept any liability if any guest has an allergic reaction to the foam and/or snow produced. All liquid provided is non-toxic and biodegradable. Funbooth LTD do not accept any liability if any guest slips on foam/snow. By its nature, it is like water and by agreeing to hire, you undertake that you accept the risk of slipping and will ensure guests are warned and aware. Children under 18 should be supervised at all times. 

On collection of the items hired, it is not our responsibility to clean the venue following your event. 

The amount of foam/snow that stays in a designated area can vary greatly, depending on factors such as temperature, humidity, type of water (hard or soft), floor surface and number of people. High temperatures, porous floors and large amounts of people will result in faster dissipation. Funbooth LTD makes no guarantees regarding the amount of foam generated or the length of time that foam will last in a dance floor environment.

Photobooths

You will arrange for an appropriate space for the Photobooth at the events venue: an area of 3m x 3m wide x 2m high on level ground.

We automatically upload Photo Albums to Funbooth LTD’s Booth Gallery and send your a link to view. You may provide this link to your guests, and it is your responsibility to notify guests that once access is granted, anyone with access may download photos contained within the gallery. 

Photobooths may only be used outside with express prior permission from Funbooth LTD. If, during the event run time the weather turns, Funbooth LTD retain the right to end the hire early and pack away OR if possible, move the photobooth inside. The time taken to move a photobooth will form part of the hire period and will NOT result in additional time being added to the end of the hire period. Please consider carefully if you’d like your photobooth outside.

Drinks, glasses, food and any other items that can cause marks are not permitted inside any photobooth. Attendants will ask guests to leave any drinks/glasses and/or food outside.

For the purpose of this agreement “The Photographer” will mean the Author of the Photograph or Funbooth LTD. And shall where the context so admits include their respective assignees, sub-licensees and successor in title.

“Photographs” and “Works” means all photographic material furnished by the Photographer, whether transparencies, negatives, prints, digital files or any other type of physical or electronic material in existence now or yet to be developed.

Funbooth LTD retains the entire copyright in the Photographs and Works at all times, throughout the World and Where reproduction of Works has taken place and settlement has not been made, the Photographer will make such charges to the publisher of those images as falls within the Copyright, Designs and Patents Act 1988.

The Title to all Photographs remains the property of the Photographer. The Title to any materials used in producing the Works is not transferred to You upon payment of the invoice.

It is you who must satisfy yourself that all necessary rights, model releases, clearances or consents which may be required for reproduction of people, places or items depicted within any Works are obtained. It is acknowledged that the Photographer gives no warranty or undertaking that any such rights, releases or consents are or will be obtained whether in relation to the use of names, people, trade marks, registered or copyright designs or Works of art depicted in any picture. In all other cases You shall indemnify the Photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances. The Photographer will not be liable for any loss or damage, for any consequential loss of profit or income however caused including negligence by the Photographer, Funbooth LTD their employees or agents or otherwise, and it is your responsibility to insure against such loss or damage.

There is no right to reject on the basis of style or composition.

The Licence to Use requires that the Photographer’s name ‘Funbooth LTD’ will be printed on or in reasonable proximity to all published reproductions of the Photograph(s). The Photographer also asserts his/her statutory and moral right to be identified in the circumstances set out in Sections 77-79 of the Copyright, Designs and Patents Act 1988 or any amendment or re-enactment thereof.

Manipulation of the image or use of only a portion of the image may only take place with the written permission of the Photographer.

Digital Data is stored by the Photographer on the understanding that the Photographer is not responsible for the future integrity of that data, or of any failure to retrieve data from the Photographer’s archive.

Subject to any previously agreed deadlines for post-production work the Photographer will carry out any such work required as soon as reasonably practicable but cannot guarantee urgent turnaround.

In respect of all editorial uses and otherwise as additionally stated You shall procure that the Photographer’s name is printed on or in reasonable proximity to all published reproductions of the Licensed Images.

Silent Disco Headphone Hire

Your equipment will include spares so therefore the numbers may differ from what you have ordered. You agree to check and count the equipment within 6 hours of arrival and advise Funbooth LTD of any discrepancy in quantities received. In the absence of this, Funbooth LTD’s records will stand as the true and accurate quantities originally received by you.

Funbooth LTD checks and maintains all equipment thoroughly, but in the eventuality that damage occurs in transit or dispatch, you will not be charged for any equipment that doesn’t work on arrival. Please report this to Funbooth LTD immediately and before the start of your event. Please mark affected equipment clearly before returning (such as stickers on equipment or placing in a labelled plastic bag). In the event that you do not familiarize yourself with the system and test it before your event please be aware that Funbooth LTD’s scope for assisting you is more limited, and Funbooth LTD cannot offer a refund in these circumstances.

In the event of equipment variation or failure, provided your event can still take place with the equipment supplied this agreement remains intact.

Funbooth LTD supplies and hosts many events in a variety of locations; Funbooth LTD is happy to advise you and demonstrate Funbooth LTD equipment in advance, such that you may check coverage range, audio connection, interference or any requirements specific to your event. It is your responsibility to ensure that the equipment supplied is suitable for the your specific purposes.

You undertake to treat the equipment well and return it in the condition provided.

You undertake to store the equipment securely and be responsible for it and the way it is stored until collection.

i) You are advised to check and count the quantity of equipment supplied prior to collection and advise Funbooth LTD of the number by email. We are not able to engage in disputes about quantities where this step has not been followed. Funbooth Ltd’s count, inventory and decision regarding missing equipment and discrepancies is final.

ii) You are advised to ensure the equipment is properly packaged and sealed in containers prior to return.

iii) If any headphones or other equipment are missing or severely damaged (unrepairable) you agree to pay Funbooth LTD the replacement costs per headset of £30+VAT each and cost per transmitter £90+VAT.

iii) Discretionary reduction – Funbooth Ltd may offer up to a 50% reduction in headphone replacement costs where full settlement is paid within 7 days of the scheduled return/collection date and where the number of missing headphones is fewer than 10 or 10% of total order (the greater quantity applies). We are not obliged to offer any discount, and you understand that where matters are not resolved within 7 days, Funbooth Ltd suffers revenue loss due to missing headphones, and also incurs further costs in trying to resolve matters with you which negates Funbooth LTD opportunity to extend this discounted period.

iv) Loss of revenue – where headphones are missing/unrepairable and the account is not settled within 8 days as per (iii), an additional hire charge of £30 per item per week or part week will be applied until the account is settled.

v) Where headphones are deemed as lost and paid for but returned more than 30 days after the event no refund will apply in respect of any fees already paid because of the loss of income already sustained.

i) It is your responsibility to ensure that headphones are collected as agreed and scheduled, even if to be collected from a third party (for example left in venue).

ii) An additional day’s hire charge will be applied for every day that collection is delayed as a result of missed collection.

In the event of a major incident affecting the headphones including, but not limited to: fire, theft and flood, please inform Funbooth LTD as soon as possible as this may affect future bookings. You must also inform your insurance company, relevant authorities such as the police, and provide Funbooth LTD with this information.

Funbooth LTD reserves the right to claim for any other losses resulting from unreasonable loss or damage, or major incidents, including, but not limited to, time and expense, and loss of revenue.

In the event of dispute, you agree to meet all legal costs of Funbooth Ltd and further costs of enforcement of any debt. 

Hire is subject to the payment of an additional refundable-upon-safe-return equipment deposit. Upon return and checking, the refund of this deposit will be processed automatically if applicable and be returned to the payment card originally paid from. This usually takes 7-10 working days. Funbooth LTD are unable to process the refund in any other way.  

Bouncy Castle

This is a weather restricted item. If you intend outdoor use, Funbooth LTD will not be held responsible if weather conditions mean that the hire cannot proceed. In these instances, Funbooth LTD will arrange one free reschedule to a different booking date within the calendar year. If you subsequently decide to cancel, the standard cancellation terms apply, less an administration fee of £10.00.

It is your responsibility to ensure that all possible steps are taken to avoid injury to users or damage to the inflatable hired.

It is your responsibility to ensure that;

  • Access for a large inflatable is not impeded, and that it is possible to access any rear or private gardens via outdoor means. Funbooth LTD cannot take any inflatable through the inside of a residential property. If adequate access is not available, it is not Funbooth LTD’s fault if upon delivery the booking cannot proceed. There will be no refund.
  • If outside, there is adequate flat, grass land for the inflatable to be set up on and an area of 6 feet (2 metres) around the space for the unit is completely clear.
  • If inside, there is adequate height clearance for the inflatable to be set up on and an area of 6 feet (2 metres) around the space for the unit is completely clear.

A responsible adult must closely supervise the inflatable at all times.

No adults are allowed on the inflatable unless you have hired an adult bouncy castle, otherwise, the inflatables have an age limit of 12 years. It is strictly prohibited for both children and adults to be on a bouncy castle at the same time. Always ensure that the inflatable is not overcrowded, and limit numbers according to the age and size of children using it. It is advised that children of mixed ages should not use the inflatable at the same time.

Do not allow children or adults to become boisterous, push, collide, fight or behave in a manner likely to injure or cause distress to others.

To avoid choking and mess, no food, drinks or chewing gum to be allowed on or near the inflatable.

All footwear, glasses, jewellery or any other hard, sharp or dangerous objects which could cause damage to other children or the equipment must be removed before using the inflatable.

No face paints, party poppers, coloured streamers or silly string to be used either on or near the inflatable.

No smoking or barbeques on or near the inflatable.

No pets to be allowed on or near the inflatable.

Climbing, hanging or sitting on walls or beams of a bouncy castle is dangerous and must not be allowed.

Do not allow anyone to bounce on the front safety step as a child could easily bounce off the step and get hurt. The step is there to assist users in getting on or off.

Ensure that no one with a history of back or neck problems is allowed on the inflatable as indeed any child who is feeling unwell or taking medication.

If the inflatable is not being used for any part of the day, please switch the blower off at the mains power.

Do not allow anyone to be on the inflatable during inflation or deflation or whilst deflated.

Please warn children of the tie down points (if appropriate) and make the area behind the unit, where the electrical blower is sited, out of bounds for children.

The bouncy castle should not be used if it becomes wet on the jumping area. If no shower cover is fitted and in the event of rain, the bouncy castle should not be used. In the event of heavy rain, it is strongly recommended that the bouncy castle be switched off. Any wetness, including bubbling (which is normal) can be dried with a towel.

Should the equipment fail for any reason, please ensure all users get off the bouncy castle immediately.

No unauthorised person should move the bouncy castle or tamper with the electrical equipment.

The inflatable must be returned in an acceptable condition, i.e. clean, unsoiled and undamaged. If it is badly soiled or damaged the you will be expected to pay an additional charge to cover the cleaning costs and our loss of earnings if the inflatable is rendered out of commission for any reason.

Inflatable Ball Pit

This is a weather restricted item. If you intend outdoor use, Funbooth LTD will not be held responsible if weather conditions mean that the hire cannot proceed.In these instances, Funbooth LTD will arrange one free reschedule to a different booking date within the calendar year. If you subsequently decide to cancel, the standard cancellation terms apply, less an administration fee of £10.00.

At the end of the hire – please gather and return all soft play equipment onto the safety mat area and all ball pool balls back in the ball pool.

It is your responsibility to ensure that all possible steps are taken to avoid injury to users or damage to the inflatable hired.

It is your responsibility to ensure that;

  • Access for a large inflatable is not impeded, and that it is possible to access any rear or private gardens via outdoor means. Funbooth LTD cannot take any inflatable through the inside of a property. If adequate access is not available, it is not Funbooth LTD’s fault if upon delivery the booking cannot proceed. There will be no refund.
  • If outside, there is adequate flat, grass land for the inflatable to be set up on and an area of 6 feet (2 metres) around the space for the unit is completely clear.
  • If inside, there is adequate height clearance for the inflatable to be set up on and an area of 6 feet (2 metres) around the space for the unit is completely clear.

A responsible adult must closely supervise the inflatable at all times.

The inflatable must be returned in an acceptable condition, i.e. clean, unsoiled and undamaged. If it is badly soiled or damaged the you will be expected to pay an additional charge to cover the cleaning costs and our loss of earnings if the inflatable is rendered out of commission for any reason.

Inflatable Dartboard

This is a weather restricted item. If you intend outdoor use, Funbooth LTD will not be held responsible if weather conditions mean that the hire cannot proceed. In these instances, Funbooth LTD will arrange one free reschedule to a different booking date within the calendar year. If you subsequently decide to cancel, the standard cancellation terms apply, less an administration fee of £10.00.

It is your responsibility to ensure that all possible steps are taken to avoid injury to users or damage to the inflatable hired.

It is your responsibility to ensure that;

The inflatable must be returned in an acceptable condition, i.e. clean, unsoiled and undamaged. If it is badly soiled or damaged the you will be expected to pay an additional charge to cover the cleaning costs and our loss of earnings if the inflatable is rendered out of commission for any reason

Traditional or Fete Games

Please note that all persons using Funbooth LTD’s Traditional or Fete games do so at their own risk.

Funbooth LTD will not be held responsible to any loss or damage to any persons or property as a result of the Traditional or Fete game us.

It is your responsibility to ensure that the Traditional or Fete games hired are suitable for your venue and area of set up. Some are only suitable for outdoor use. Funbooth LTD will not be held responsibility if upon delivery and set up it is discovered that one or more games cannot be set up adequately. There will be no refund in these instances.

These guidelines are for the safety for everyone who may use or be around the traditional or fete games.

It is your responsibility to ensure that these guidelines are fully adhered to at all times.

No food, drink, gum or smoking is allowed near Traditional or Fete games. This will avoid choking and any mess or damage.

Please note if the traditional or fete games are returned in a dirty or soiled condition, a cleaning charge will occur.

Missing or broken parts will be subject to a fee, which in some cases may be the total replacement cost of the item if individual parts are not available. Funbooth LTD will invoice accordingly within 7 days of collection, detailing the required costs. If payment is not received within 30 days, Funbooth LTD will apply interest and a debt collection fee of £40. Funbooth LTD reserves the right to pursue court action in the event of invoices remaining unpaid.

A responsible adult (over18) must supervise the games at all times. It is your responsibility to ensure the games are used correctly and not being used for anything other than as intended. Always ensure that there is no fighting or pushing and that guests do not behave in manner which is likely to cause injury or distress to others. Ensure everyone plays the games safety at all times.

If you are setting the games up make sure there is plenty of space away from any buildings to ensure the risk of damage is greatly reduced whilst the games are in use. Funbooth LTD will not be held responsible for any property damage.

When the games are set up outside Funbooth LTD cannot and will not be held responsible for any damage to lawns or garden area.

It is your responsibility to ensure that the games are ready for collection at the agreed time, and in the same state and condition as they were delivered in.

Party DJ

You understand any DJ or host may be sub-contracted by Funbooth LTD.  In this respect, Funbooth LTD acts as a contractor agency in issuing this Contract to self-employed DJ’s/Hosts.  

You will inform Funbooth LTD prior your event is there is a sound limiter installed

Funbooth LTD DJ’s or Hosts will respond to any guests reasonable request(s) and conduct themselves in a professional manner throughout attendance at The Venue.

Funbooth LTD will respond to the venue management’s reasonable requests such as volume, placement of equipment and or any other reasonable request(s). Funbooth LTD shall be in no way liable for breach of byelaws or conditions under which the venue is leased, hired or entrusted to the venue management.

You will assume responsibility that all appropriate licences as required by law are in force at the time of the Event.

You agree to provide adequate supervision of guests and will ensure that the venue management adequately supervises customers and or staff on site premises.

Where the function may include guests under the age of 16 years, you (or parent/guardian) are responsible for the behaviour and safety of any minors attending, and Funbooth LTD will not be held responsible for any explicit song request made by a guest causing offence.

You agree to compensate for any loss of or damage to DJ’s/Funbooth LTD equipment, vehicle(s) and/or personal belongings caused by your guests, other venue customers and/or venue staff as sought, including any additional costs.

Funbooth LTD will accept music lists and requests in advance of functions and will endeavour to play a reasonable number of your chosen requests, provided such requests are submitted in writing or via Funbooth LTD’s online portal at least two weeks before the event. You confirm you understand that Funbooth LTD cannot guarantee the inclusion of any difficult to source, obsolete or deleted titles either requested at the event or previously notified.

Where you request that Funbooth LTD start the Contracted Service at an earlier time prior to the actual start of the function, You acknowledge that a charge may be made for this additional service, and that this service will be subject to availability.  

Where Funbooth LTD is engaged to work alongside another DJ/Live Entertainment Act(s)/Production Service(s) from another supplier, it is your responsibility to ensure that adequate space exists within the venue for all DJs/Live Entertainment Act(s)/Production Service(s) to set up their equipment and that separate power outlets exist.

Funbooth LTD and Contracted DJ(s)  will NOT accept liability for any equipment directly or indirectly connected to ours that has not been PAT tested and does not comply with electrical safety regulations.

Funbooth LTD and Contracted DJ(s) reserve the right to refuse to connect any equipment to our own if we deem it unsafe.

Where the event is being held in a marquee or outside, you will ensure that the work area is dry and that a minimum of 2x 13A power sockets are located within 5 metres of this area. Please note: bad weather or impending bad weather on the day will not allow Funbooth LTD to commence entertainment outdoors under any circumstances. Funbooth LTD accepts no responsibility for damage to electrical equipment if caused as a result of working in inappropriate weather conditions. Funbooth LTD reserves the right, in good faith, to stop or cancel any service should the weather pose a potential danger to staff, the equipment, or audience. Every effort will be made to continue the performance. However, safety is paramount in all decisions. 

Where background music is supplied by Funbooth LTD, the music will be played through the disco pa system from the position where the DJ is set up (unless otherwise previously agreed).

All media or content for presentations must be delivered to Funbooth LTD at least two weeks prior to the event and in the format specified. Funbooth LTD cannot guarantee that content delivered past two weeks before the event will be a) be displayed b) work correctly.

You agree that any re-engagement of Contracted DJ must be transacted through Funbooth LTD. Any enquiry to the DJ in respect of any engagement by guests, customers and/or staff must be transacted through Funbooth LTD.  By signing, You agree to negotiate all future Bookings of the DJ/Host with Funbooth LTD and not with the DJ/Host directly, for the period covering the issue date of this contract until 24 months after the event date on this contract.

Fun TAG Archery

This is an age restricted activity. Under 8’s are not permitted to take part.

Participants cannot be under the influence of alcohol and/or drugs.

It is your responsibility to ensure all participants are of suitable age and ability to take part. Funbooth LTD will not accept liability or issue refunds if a guest cannot participate due to their age or being under the influence.

This is an indoor or outdoor activity. If outdoors, a suitable flat area of grass or AstroTurf is required. A ‘vs’ game cannot take place on any hardstanding or similar. Target practice is possible on concrete or hard standing.

It is your responsibility to ensure that any area outside in use is clearly marked and/or barriered for public safety. Funbooth LTD may add additional barrier/safety signage but this is at our discretion based on the event type.

Each participant will be required to read and sign a waiver before game play commences on the day. Under 18’s will require a competent, responsible adult to confirm authorisation prior to game play.

All participants are required to wear a face mask at all times. Even players within the play area on the sidelines and referees are required to wear a mask during game play. Funbooth LTD will ensure that it is properly fit to the head so that it does not move excessively or slip down.

Participants are not to dry fire (fire without an arrow) a bow. Firing a bow without an arrow causes the limbs to absorb the shock the arrow was designed to take. Dry firing a bow can cause fractures in the bow limbs.

Participants are always to hold a bow by the riser and lay it flat when not in use. Standing or leaning the bow against a wall can cause limbs to warp over time.

Participants will be advised that they are not fire a bow outside of the game play area, be it a pitch for ‘vs’ or aiming at static targets.

During the game, please keep in mind that everyone is there to have fun. If you see any activity that is unsafe, please notify the Funbooth LTD host so the issue can be corrected immediately.

  • Remove earrings, other jewellery, and piercings prior to gameplay.
  • Do not use equipment to deflect, hit or deliberately contact incoming arrows. Swinging equipment at other objects can damage equipment and cause injuries.
  • Do not move or lean on the bunkers.
  • Do not shoot at players in the neutral zone or outside the field boundaries.

Funbooth LTD will provide a competent host as part of the service, If the host feels that participants are:

  • Not listening to safety instructions before, and during, game play
  • Not behaving in a safe and/or appropriate manner 
  • Abusing the equipment on hire in any way
  • Under the influence of alcohol and/or drugs

They are authorised to stop game play for everyone and issue warnings. Continued poor behaviour and/or attitude that puts any player, staff member, or member of the public at risk will result in the activity being halted. It is at the Funbooth LTD’s hosts discretion as to whether the activity resumes or not. There will be no continuation of hire time if the play has had to stop as a result of participant behaviour.

Wedding Photographer

For the purpose of this agreement “The Photographer” will mean the Author of the Photograph or Funbooth LTD. And shall where the context so admits include their respective assignees, sub-licensees and successor in title.

“Photographs” and “Works” means all photographic material furnished by the Photographer, whether transparencies, negatives, prints, digital files or any other type of physical or electronic material in existence now or yet to be developed.

Where time is of the essence the Photographer entirely at their own discretion may accept an instruction given orally, in this event the Photographer shall accept no liability for any error in executing the order.

 Funbooth LTD retains the entire copyright in the Photographs and Works at all times, throughout the World and Where reproduction of Works has taken place and settlement has not been made, the Photographer will make such charges to the publisher of those images as falls within the Copyright, Designs and Patents Act 1988.

 The Title to all Photographs remains the property of the Photographer. When the License to Use has expired the Photographs must be returned to the Photographer in good condition within 30 days and any archived digital files destroyed. The Title to any materials used in producing the Works is not transferred to You upon payment of the invoice.

The License to Use comes into effect from the date of payment of the relevant invoice(s). No use may be made of the Photographs before payment in full of the relevant invoice(s) without the Photographer’s express permission in writing. Any permission that may be given for prior use will automatically be revoked if full payment is not made by the due date. Where restricted in the Agreement, permission to use the Photographs for other purposes will normally be granted upon payment of a further fee to be mutually agreed.

Note: A written agreement must be reached with the Photographer before the Photographs may be used for other purposes. Where uses of an image are made which breach the licence to use further charges will be made. Any reproduction rights granted are by way of licence only and no partial or other assignment of copyright shall be implied. On You’s death or bankruptcy or (if You is a Company) in the event of a Resolution, Petition or Order for winding-up being made against it, or if a Receiver or an administration is appointed, any licence granted shall immediately cease.

Unless agreed to in writing on the License to Use and the Invoice no exclusivity is given or implied to you. The Photographer retains the right in all cases to use or sell the Photographs. Exclusivity will not be unreasonably withheld but only on written agreement with the Photographer before work commences.

The Photographer will keep confidential and will not disclose to any third parties or make use of information communicated to him/her in confidence for the purposes of the photography, save as may be reasonably necessary to enable the Photographer to carry out his/her obligations in relation to the commission. It shall be the sole responsibility of You to arrange for any third party involved in the Assignment to enter into any confidentiality agreement.

The Photographer will not be liable for any breach of confidentiality by any third party.

It is you who must satisfy yourself that all necessary rights, model releases, clearances or consents which may be required for reproduction of people, places or items depicted within any Works are obtained. It is acknowledged that the Photographer gives no warranty or undertaking that any such rights, releases or consents are or will be obtained whether in relation to the use of names, people, trade marks, registered or copyright designs or Works of art depicted in any picture. The Photographer shall only be responsible for obtaining such clearances if this has been expressly agreed in writing before the shoot. In all other cases You shall indemnify the Photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances. The Photographer will not be liable for any loss or damage, for any consequential loss of profit or income however caused including negligence by the Photographer, Funbooth LTD their employees or agents or otherwise, and it is your responsibility to insure against such loss or damage.

Where extra expenses or times are incurred by the Photographer as a result of alterations to the original brief by you, or otherwise. You shall give approval to and be liable to such extra expenses or fees, in addition to the fees and expenses shown on the Estimate as having been agreed or estimated.

There is no right to reject on the basis of style or composition.

The Licence to Use requires that the Photographer’s name ‘Funbooth LTD’ will be printed on or in reasonable proximity to all published reproductions of the Photograph(s). The Photographer also asserts his/her statutory and moral right to be identified in the circumstances set out in Sections 77-79 of the Copyright, Designs and Patents Act 1988 or any amendment or re-enactment thereof.

The licence only applies to you, named on this contract, and product stated on the Licence to Use.

Save for the purposes of production for the licensed use(s), the Photographs may not be stored or archived in any form without the written permission of the Photographer.

Manipulation of the image or use of only a portion of the image may only take place with the written permission of the Photographer.

Digital Data is stored by the Photographer on the understanding that the Photographer is not responsible for the future integrity of that data, or of any failure to retrieve data from the Photographer’s archive.

Following completion of the shoot the Photographer will deliver the Material to You as soon as reasonably practicable and in the agreed format to enable You to select the Licensed Images.

Subject to any previously agreed deadlines for post-production work the Photographer will carry out any such work required as soon as reasonably practicable but cannot guarantee urgent turnaround.

Engagements of third party suppliers, including models, are subject to such terms and conditions as those parties may require which shall be made available by the Photographer on request.

In respect of all editorial uses and otherwise as additionally stated You shall procure that the Photographer’s name is printed on or in reasonable proximity to all published reproductions of the Licensed Images.

You shall indemnify the Photographer and keep him/her and their respective officers and employees indemnified on a continuing basis against all liabilities, claims, costs, damages and expenses claimed or incurred (including legal costs) or licence fees due by reason of any infringement claim, or alleged infringement, of any intellectual property rights relating to any failure by You to obtain third party clearances or arising out of use of the Material by You or the Advertiser outside of the Usage Licence or otherwise as a result of any breach by You or the Advertiser of these terms.

The Photographer shall not be liable to You for any loss of profit, loss of contracts, loss of business or revenues, loss of production or for any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of the Photographer, Photographer’s employees, agents or sub-contractors or otherwise) which arise out of or in connection with the shoot.

The Photographer’s maximum aggregate liability for all losses, damages, costs, claims and expenses however or whenever arising out of or in connection with these Terms shall in any event be limited to the total amount of the fees paid to the Photographer in relation to the relevant Assignment.

Notwithstanding the above, nothing in these terms excludes or limits the liability of the Photographer for death or personal injury caused by the Photographer’s negligence or that of his/her employees, agents or sub-contractors, for any fraudulent statement or act or for any matter which it would be illegal to exclude.

The Photographer hereby disclaims any warranties, conditions and other terms on or relating to the services hereunder or any parts thereof which might otherwise be implied whether by statute, law, custom, course of dealing or otherwise, including without limitation any warranty, condition, or other terms of merchantability, quality, fitness for purpose or non-infringement to the fullest extent permitted by law.

Bingo Host Hire

Bingo is legally considered to be gambling and therefore falls under UK gambling legislation. 

Non-commercial bingo nights are considered ‘gaming’ by the Gambling Commission.

If you are running one of these events for commercial purposes and intending to make a profit, then you will need a gambling license in order to operate. If you want more information on how to go about this, please visit the Gambling Commission website. 

You do not need a gambling license to run a fundraising event or a private bingo night, but you must follow key rules:

The key rules

  • Each player may only be charged £8 per day for anything related to the game 
  • This includes entry fees and stakes, but doesn’t include the costs of drinks and food
  • The total value paid out in prizes must be below £600 in total
  • After costs are deducted, the proceeds raised must not be used for private gain and must all be given to the specified good cause
  • Players must be told what good cause the bingo night will benefit before the game begins
  • Prizes must be advertised in advance and can not depend on how many people are playing. If you order prizes from us, we will advise you of what we provide.
  • Under 18s are allowed to participate, as long as the above rules are met

Generator Hire

The Generator supplied shall be in good working order and fit for the purpose for which the equipment of that kind is normally used. The generator does not purport to be new or equal to new, but all equipment hired out by Funbooth LTD will be in good condition and fit for normal use.

Funbooth LTD do not warrant that the Generator shall be fit for any special purpose other than as intended and described.

You shall satisfy yourself as to the condition of the Generator supplied at the time of acceptance of the Generator upon delivery.

You warrant that you are competent and qualified to use the equipment in the way for which it is designe

Unless notice to the contrary is received by Funbooth LTD within 24 hours of the supply of the Generator then same shall be deemed to be supplied in good working order, except for defects which could not have been discovered by reasonable examination.

It is your responsibility to ensure safe unloading and loading is possible.  Generators are only for ground floor use, unless adequate lift facilities exist. If it is found upon delivery that the generator cannot be placed adequately, the booking will be cancelled without refund.

The Generator must not be removed from the site to which it was delivered without written authority from Funbooth LTD.

The Generator or any part thereof shall not be re-hired, sublet or lent to any third party without the written consent of Funbooth LTD

You shall, during the hire, be responsible for the safe keeping and maintenance of the Generator, for lubricating as instructed by Funbooth LTD and ensuring that the fuel level remains at level required for correct operation of the Generator. At no time should you operate the Generator after it has become defective, damaged or in a dangerous state. Failure to observe the aforementioned will result in you  being liable to Funbooth LTD for the cost of repairs and also for the Hire charges accruing whilst the Generator is idle due to breakdown or damage whilst repairs are being progressed.

You shall permit Funbooth LTD or their agents access to Generator at reasonable times to adjust, inspect, service and maintain to repair same.

In the event of breakdown of the Generator which is not readily repairable, Funbooth LTD shall be entitled to substitute Generator of a similar type. If Funbooth LTD are not able to do so, the hire shall be terminated as from the date of the notification of breakdown.

Where breakdown of the Generator arises from a cause other than through the development of a fault, not discoverable by reasonable examination, all costs incurred by Funbooth LTD in repairing the Generator including transport costs shall be chargeable to you.

Funbooth LTD must be notified immediately of any accidents involving their Generator.

Responsibility for loss or damage to the Generator is accepted by you from the time the Generator is delivered to the site until it is removed from the site by, or on the instructions of Funbooth LTD. This responsibility will also apply whilst the Generator is on site during any period prior to the commencement of the hire period or after it’s termination whilst the Generator is awaiting collection.

During the continuance of the hire period, you shall be liable to Funbooth LTD for the cost of all loss or damage to Generator from any cause whatsoever.

In the event of loss or damage to the Generator, hire charges shall continue until such time and date as you pay for the cost incurred by Funbooth LTD  in respect of such loss or damage.

In the event of total loss, you shall be liable to Funbooth LTD for the replacement as new equipment.

It is your responsibility to ensure that cabling and installation of the hire equipment is safe and in accordance with the IEE Wiring Regulations 17th Edition.

You shall at all times indemnify Funbooth LTD in respect of all claims by any person whatsoever for injury to person or property caused by, or in connection with or arising out of, the use of the Generator or in respect of all costs and charges in connection therewith.

Funbooth LTD shall not be liable for any consequential loss or damage arising from this contract.

It is a condition of the hire agreement that when the generator is out on hire, you will need to source your own hired in Generator insurance, therefore you are responsible for loss and/or damage whilst it is under their custody and control.

Fuel, oil and grease shall when supplied by Funbooth LTD will be charged at net cost and when supplied by you shall be of a grade and type specified by Funbooth LTD.

Funbooth LTD will set up the generator within a cordon of some sort, subject to the location and ventilation of the space. Once set up, the cordon is not to be moved or tampered with.

It is your responsibility to supervise all persons and ensure no unauthorised access is granted to the generator.

You authorise Funbooth LTD to bring its vehicle onto your property to deliver the generator and to collect the same at the end of the hire period or at any other time permitted by this agreement. Funbooth LTD shall have no liability whatsoever to the Hirer nor third parties for any damage that may be caused by the Owner during delivery or recovery, whether to driveways, or underground services or otherwise howsoever and whether or not the Owner was negligent.

Soft Play

It is the responsibility of the hirer to check the site measurements for the required soft play and also to ensure that there is adequate safe space surrounding the play equipment. If adequate space is not available at the venue site for the package ordered, we reserve the right to remove certain items to ensure the safe operation of the equipment. On this basis you will still be charged for the item(s). Please ensure you double check measurements.

You agree that the area where the party equipment is to be situated will be free from obstruction or debris and that the area is suitable for use of our equipment.

All our equipment will be delivered in a clean, safe and sanitary state. Equipment must be collected in the same state. If equipment damaged or lost you will be expected to pay the full amount for the equipment priced as brand new within 14 days of the date of hire.

At the end of the hire – please gather and return all soft play equipment onto the safety mat area and all ball pool balls back in the ball pool.

The Hirer is responsible for the safe keeping of the Soft play. You will be charged for theft or any damage caused to it or for any items missing from it on its return. Soft play being kept overnight must be locked away to avoid theft. Full replacement charge for any missing items will incur. This includes any accessories which accompany the equipment, i.e. mats etc.

In the event of rain ALL Soft play and Play Equipment must be covered or taken indoors / under cover to prevent it from getting wet and water damage occurring. All equipment must be towel dried thoroughly before use re-commences.

Only Funbooth LTD staff are authorised to collect the Soft play and equipment. Under no circumstances should any of the equipment be handed over to anyone other than our staff. If you are unsure of any staff member collecting please contact Funbooth LTD on the 0800 023 6408.

The Hirer must ensure the equipment is supervised at ALL times by a responsible person over the age of 18. Funbooth LTD does not supervise the event. Funbooth LTD or their staff accepts no liability for any damage, accidents or injuries that may occur whilst the equipment is on hire.

Funbooth LTD will set up the equipment taking into account full safety of the children, and therefore large equipment, such as the ball pool must not be moved. We will not accept any liability for accidents, injury or damage during the period of hire if this has occurred. Photographs are taken to evidence this upon setup.

The Soft play and all other Play Equipment is strictly for use by children under the age of 6 years. Under no circumstances should Adults or teenagers play on the Soft play or Play Equipment as this will potentially result in damage to the Equipment and/or injury to the individual(s)concerned.

Adults must not lean or sit on any Soft play/Ball Pools.

Do not allow children with medical conditions, which may put them at risk of injury (i.e. brittle bone disease or temporary injuries), to use the Soft play, or Play Equipment.

Avoid mixing older children on the Soft play or Play equipment at the same time as younger ones.

No food, drink or chewing gum to be allowed on or near the Soft play. If the equipment is collected in a dirty condition then the person hiring it will incur a cleaning charge.

Strictly NO glass! Drinking glasses or bottles are not to be used on or near the Soft play.

STRICTLY no alcohol or drug use on or near the Soft play or play equipment  – Funbooth LTD will not be held liable for any damage, accidents or injury that occurs due to the consumption and effects of alcohol and/or drug use.

Please ensure that the Soft play and Play Equipment is kept in a clean, dry condition. Any spillages must be cleaned and dried as soon as they occur – if we have to have the equipment professionally cleaned before the next hire, then you will incur a cleaning charge.

Shoes MUST be removed before using the soft play, or play equipment. Parents/guardians who enter the Soft play area or walk over the padded floor tiles whilst supervising must remove their shoes, particularly heels. Any damage may result in the Hirer having to pay an additional fee for replacement or repair. For hygiene reasons, socks should be worn at all times whilst using the Soft play, Play Equipment.

The Hirer must ensure that all sharp objects, including but not limited to, badges, spectacles, earrings, jewellery etc. are removed prior to accessing the Soft play, or Play Equipment. to ensure it remains undamaged from but not limited to, scratches, tears, dirt (of any kind), detached from its connecting item (if applicable) and in the same working condition as delivered. If damage does occur the Hirer will incur a repair or replacement charge to be paid immediately, unless otherwise agreed.

No face paints, party poppers, confetti, coloured streamers or silly string to be used either on or near the Soft play or play equipment as staining may occur for which the Hirer will be liable.

Strictly NO acrobatics or gymnastics to be performed on the Soft play or play equipment.

Children must NOT push, collide, fight or behave in a manner likely to injure or cause distress to others.

Always ensure that no overcrowding occurs on all Soft play or Play Equipment limit numbers according to the age and size of children using it.

No furniture to be placed on the mats as this may cause damage.

No smoking or barbecues near the Soft play or play equipment

No pets or animals to be allowed on or near the Soft play or play equipment.

Please ensure you take all reasonable precautions to protect the equipment from damage.

Most importantly please ensure that you take all reasonable precautions to protect the child from harm and danger.

Instax Camera

You shall not remove any labels from and/or interfere with the Instax camera , their working mechanisms or any other parts of them and shall take reasonable care of the Instax camera and only use them for their proper purpose in a safe and correct manner in accordance with any operating and/or safety instructions provided or supplied by Funbooth LTD.

You must notify Funbooth LTD immediately after any malfunction, whether intermittent or not, any breakdown, loss and/or damage to the Instax camera;

You should take adequate and proper measures to protect the Instax camera from theft, damage and/or other risks;

You must notify Funbooth LTD of any change of event details and upon Funbooth LTD’s request provide details of the location of the Instax camera;

You will permit Funbooth LTD at all reasonable times and upon reasonable notice to inspect the Instax camera including procuring access to any property where the Instax camera are situated;

You will keep the Instax camera at all times in your possession and control and not to remove the Instax camera from the country where You is located and/or the country where Funbooth LTD is located without the prior written consent of Funbooth LTD;

You will be responsible for the conduct and cost of any testing, examinations and/or checks in relation to the Instax camera required by any legislation, best practice and/or operating instructions except to the extent that Funbooth LTD has agreed to provide them as part of any Services;

You must not continue to use Instax camera in the event that they malfunction or where they have been damaged and will notify Funbooth LTD immediately if the Instax camera are involved in an accident resulting in damage to the Instax camera, other property and/or injury to any person; and

The Instax camera must be returned by you in good working order and condition together with all other items supplied, with the exception of the film cartridges.

If the Instax cameras are returned in damaged, unclean and/or defective state except where due to fair wear and tear and/or an inherent fault in the Instax camera You shall be liable to pay Funbooth LTD for the cost of any repair and/or cleaning required to return the Instax camera to a condition fit for re-hire.

You shall be responsible for all expenses, loss (including loss of Rental) and/or damage suffered by Funbooth LTD arising from any breakdown of the Instax camera due to You’s negligence, misdirection and/or misuse of the Instax camera.

You will pay to Funbooth LTD the replacement cost of any Instax camera which are lost, stolen and/or damaged beyond economic repair during the Hire Period.

You must not repair or attempt to repair the Instax camera unless authorised to do so in writing by Funbooth LTD.

Toddler TeePee

It is your responsibility to inform guests accordingly to these Terms and Conditions. 

Funbooth LTD are not responsible for the care and safety of the children and cannot be held responsible for any injury caused to a child whilst using the hired equipment.

This is NOT a babysitting service. Adult supervision is required at all times.

The Toddler TeePee package is aimed at children under 6. Age-appropriate toys and soft furnishings are provided, however as with any service aimed for use by children, constant supervision is required.

All hired equipment remains the property of Funbooth LTDat all times. If you have purchased the Extra; Arts Pack or Extra: Party Bags, these become your property upon delivery.

Any damage or stains to tent, bedding or any other hire equipment will result in the holding of the £50 equipment deposit. Should this not cover the cost of cleaning, or replacement, additional charges will be invoiced to the you to cover these. 

Any damage to equipment caused by neglect, misuse, loss or failure to follow instructions provided, will deem you liable for full repair or replacement costs in addition to any loss of business. The security deposit will be held in full or as part payment and any additional costs will be invoiced to the you.

All sizes quoted are approximate.

Funbooth LTD reserves the right to substitute hired equipment with that of a similar value and type without notice in the event of previous loss or damage.

Equipment shall be used only for the intended hired purposes. Climbing or hanging on to the tents is dangerous and MUST NOT be allowed.

It is your responsibility to ensure duty of care and supervise children at all times with the hired equipment. This service is aimed at children aged 3 and under. Older children should be discouraged from using the equipment. 

Smoking is strictly prohibited for fire hazard and to prevent cigarette smoke odour on the tents and equipment. If this is ignored and the equipment is returned having been in a smoke environment, the security deposit of £50 will not be refunded and will be used to clean or replace the equipment as  necessary.

All shoes, and sharp objects should be removed prior to use of the equipment.

Funbooth LTD asks you to refrain from allowing pets on or in any of the equipment. Should the equipment require extensive cleaning due to pet hair, part or all of the security deposit will be held to cover the cost of cleaning. 

To avoid stains that we cannot remove, Funbooth LTD ask the following: 

Any nail varnish recently applied must be completely dry before entering the equipment. It is the responsibility of you to ensure this. 

No food or drink is to be consumed on or near the equipment

No fabric pens are used in other around the equipment

No pens, paints, crayons or markers are used in around the equipment

No glow sticks are used in or around the equipment. 

Heating, cooking or the use of other gas or electrical appliances is prohibited within 5m of the equipment.

No fire, candle (including those on birthday cakes) or other naked flame is to be lit within 5m of the equipment.
No mobile phones or other equipment to be left charging in or near the indoor teepees.

All equipment is delivered, assembled and styled by Funbooth LTD.

Funbooth LTD will ensure that all equipment is safe and working prior to installation at the event.

It is the responsibility of the you to check that they have adequate room for the required tents and hired equipment.

The equipment must be installed on the ground floor. Should you wish to use the hired equipment upstairs or in an external building, you should inform Funbooth LTD at the time of booking, with all the relevant information including but not limited to the floor level and the proximity to available parking. In such an event, this may incur an additional charge which will be quoted at the time of booking. 

You must ensure that the party area is clean and safe ready for the installation of the equipment. If the area isn’t deemed clean this may result in part or all of the security deposit being held.

You must ensure that the space is cleared prior to our arrival. Funbooth LTD will not be responsible for moving furniture or belongings in order to make room for the equipment. If Funbooth LTD has to wait for the area to be cleared on arrival, this will result in a charge of £1 per minute that Funbooth LTD is kept waiting, which will be deducted from the security deposit.  

Funbooth LTD reserves the right to refuse delivery and installation should the venue or site be deemed unsuitable. In this case the full hire fee will be due and non-returnable. The security deposit of £50 will be refunded to you. 

Once the equipment has been installed you agree to not move or tamper with any of the equipment.

All equipment must remain inside at all times.

It will take between 60 minutes for Funbooth LTD to install the hired equipment. We ask that during the installation, the area is kept free of distractions, so as to not delay the installation process. 

Funbooth LTD reserves the right to remove equipment should they feel that the customers conduct or use of the equipment be dangerous to themselves, anyone using the equipment or the safety of the hired equipment. In all such cases, the equipment will be removed and no refunds will be given. 

Funbooth LTD will return at the agreed time, to dismantle and remove the hired equipment.  A tour around the tents and items will be done prior to breakdown. Any delay in access to the hired equipment will result in a £10 charge per 15 minutes over the arranged time. Charges will be rounded up to the nearest 15 minutes delay.

It is your responsibility to inform guests accordingly to these Terms and Conditions. 

All bedding and soft furnishings are washed using non biological detergent. Please advise us in advance if a child has an allergy to bedding or a particular washing detergent so we can discuss options with you.

Funbooth LTD cannot be held responsible for any allergic reactions to bedding/soft furnishings.

We use quality products and follow strict hygiene routines.

KIds Party DJ

You understand any DJ or host may be sub-contracted by Funbooth LTD.  In this respect, Funbooth LTD acts as a contractor agency in issuing this Contract to self-employed DJ’s/Hosts.  

You will inform Funbooth LTD prior your event is there is a sound limiter installed

Funbooth LTD DJ’s or Hosts will respond to any guests reasonable request(s) and conduct themselves in a professional manner throughout attendance at The Venue.

Funbooth LTD will respond to the venue management’s reasonable requests such as volume, placement of equipment and or any other reasonable request(s). Funbooth LTD shall be in no way liable for breach of byelaws or conditions under which the venue is leased, hired or entrusted to the venue management.

You will assume responsibility that all appropriate licences as required by law are in force at the time of the Event.

You agree to provide adequate supervision of guests and will ensure that the venue management adequately supervises customers and or staff on site premises.

Where the function may include guests under the age of 16 years, you (or parent/guardian) are responsible for the behaviour and safety of any minors attending, and Funbooth LTD will not be held responsible for any explicit song request made by a guest causing offence.

You agree to compensate for any loss of or damage to DJ’s/Funbooth LTD equipment, vehicle(s) and/or personal belongings caused by your guests, other venue customers and/or venue staff as sought, including any additional costs.

Funbooth LTD will accept music lists and requests in advance of functions and will endeavour to play a reasonable number of your chosen requests, provided such requests are submitted in writing or via Funbooth LTD’s online portal at least two weeks before the event. You confirm you understand that Funbooth LTD cannot guarantee the inclusion of any difficult to source, obsolete or deleted titles either requested at the event or previously notified.

Where you request that Funbooth LTD start the Contracted Service at an earlier time prior to the actual start of the function, You acknowledge that a charge may be made for this additional service, and that this service will be subject to availability.  

Where Funbooth LTD is engaged to work alongside another DJ/Live Entertainment Act(s)/Production Service(s) from another supplier, it is your responsibility to ensure that adequate space exists within the venue for all DJs/Live Entertainment Act(s)/Production Service(s) to set up their equipment and that separate power outlets exist.

Funbooth LTD and Contracted DJ(s)  will NOT accept liability for any equipment directly or indirectly connected to ours that has not been PAT tested and does not comply with electrical safety regulations.

Funbooth LTD and Contracted DJ(s) reserve the right to refuse to connect any equipment to our own if we deem it unsafe.

Where the event is being held in a marquee or outside, you will ensure that the work area is dry and that a minimum of 2x 13A power sockets are located within 5 metres of this area. Please note: bad weather or impending bad weather on the day will not allow Funbooth LTD to commence entertainment outdoors under any circumstances. Funbooth LTD accepts no responsibility for damage to electrical equipment if caused as a result of working in inappropriate weather conditions. Funbooth LTD reserves the right, in good faith, to stop or cancel any service should the weather pose a potential danger to staff, the equipment, or audience. Every effort will be made to continue the performance. However, safety is paramount in all decisions. 

Where background music is supplied by Funbooth LTD, the music will be played through the disco pa system from the position where the DJ is set up (unless otherwise previously agreed).

All media or content for presentations must be delivered to Funbooth LTD at least two weeks prior to the event and in the format specified. Funbooth LTD cannot guarantee that content delivered past two weeks before the event will be a) be displayed b) work correctly.

You agree that any re-engagement of Contracted DJ must be transacted through Funbooth LTD. Any enquiry to the DJ in respect of any engagement by guests, customers and/or staff must be transacted through Funbooth LTD.  By signing, You agree to negotiate all future Bookings of the DJ/Host with Funbooth LTD and not with the DJ/Host directly, for the period covering the issue date of this contract until 24 months after the event date on this contract.

Backdrop

It is your responsibility to provide adequate space at the venue to set up the Backdrop(s). This means an adequate amount of floor space to lay out the poles, and clear access to the space where the backdrop will be on display.

Any cosmetic damage to the backdrop(s) will be charged accordingly. 

These backdrop(s) are for indoor use only. In the event that the backdrop(s) are used outside (not under cover e.g. a marquee) additional charges will apply, and the backdrops are only to be used outside with the prior agreement of Funbooth LTD.

You are responsible for the backdrops during the hire agreement; they must be ready for collection in the same state that they were delivered in.

Once the backdrops are set-up, they should not be moved unless agreed beforehand.  Funbooth LTD do not accept any liability for injury caused due to moving backdrops after set-up.

The backdrops should be placed against a wall, with no access behind them.

Children should be supervised at all times near the backdrops. They are delicate.

Bubble Machine

Outdoor use of the bubble machine is only allowed after express permission being granted directly by Funbooth LTD.

Once set up, Funbooth LTD do not recommend moving the machine HOWEVER if you need to;

  • Turn off the machine
  • Turn off the power
  • Unplug the machine
  • Move carefully – there may be liquid still inside
  • Ensure machine is set on a level surface
  • Plug machine back in – ensure there is suitable slack in any power lead and that it is not in any area whereby someone could trip over the lead. We recommend taping the lead to the ground.
  • Turn the power back on
  • Turn the machine back on

Funbooth LTD do not accept any liability for injury caused due to moving machines after set-up. Any spillages will need to be cleaned immediately to avoid risk of slipping. 

By hiring this item this is your acceptance that you have specific permission from the venue representatives to use the item on their premises. They must be aware that the bubble machines may cause damage in the same way that water would. 

Children are NOT to touch the machines. It is recommended that all children are supervised in the presence of the bubble machines.  

Unless agreed beforehand, additional liquid for the bubble machine will NOT be provided. It is your responsibility to ensure you have hired enough and use it wisely during your event.

Funbooth LTD do not accept any liability if any guest has an allergic reaction to the bubbles produced. All liquid provided is non-toxic and biodegradable. Funbooth LTD do not accept any liability if any guest slips. By its nature, it is like water and by agreeing to hire, you undertake that you accept the risk of slipping and will ensure guests are warned and aware. Children under 18 should be supervised at all times. 

On collection of the items hired, it is not our responsibility to clean the venue following your event. 

Funbooth LTD makes no guarantees regarding the amount of bubbles generated. By their nature, bubbles will be impacted by weather, temperature, room size, number of guests and other factors.

Karaoke Hire

Funbooth LTD use a third party karaoke catalogue. This is updated on a regular basis, so Funbooth LTD is unable to guarantee availability of certain songs at any time. What is present on the catalogue on the date of your booking is what is available.

Song options include explicit lyrics where noted. It is not Funbooth LTD responsibility to ensure that songs chosen by guests are suitable for audience members under 18, and Funbooth LTD take no responsibility if any offence is caused through a guests song choice.

The Karaoke host will manage requests from guests; this means that prior to the end of the service time, they will state that they have received an adequate number of requests for songs and cannot take any more. This also means that if one guest requests a lot of songs at once, they may re-order requests so that it is not the same guest singing constantly. Likewise, repeat requests are unlikely to be honoured (if a song has already been played/requested). This is to ensure a good show for the other guests present.

The host will ask for the guest to head up to the karaoke performance area when ready for them to sing. They will repeat their request a couple of times, but if the guest does not respond when called, they will move on to the next request. It is at the discretion of the host as to whether they revisit the request at a later point in the evening.

We reiterate that our hosts will not tolerate any abusive behaviour, and if subjected to such, we reserve the right to end the service immediately and leave. In these situations, there will be no refund. Likewise, if guests are rowdy and there is a risk to our equipment, we reserve the right to halt karaoke until back under control. In this circumstance, no additional time will be added to the service to make up for the missed time due to guest behaviour, and there will be no refund.

4 Loss or Damage

No Liability is accepted for;

4.1 Loss or damage to personal property

Loss of or damage to property belonging to or travelling with any event guest or attendee. For example, watches, jewellery, cameras or clothing.

4.2 Personal Injury

Personal injury or death of any event guest or attendee however caused unless by proven negligence of Funbooth ltd.

5 Termination of Hire

5.1 Abuse or threatening behaviour

Funbooth LTD will not tolerate any abuse or threatening behaviour to our employees. If this occurs, Funbooth LTD retain the right to terminate the hire, with no refund payable for hire time that has been cut short. We are providing a service to you; our staff should be treated with the respect they deserve.

Funbooth LTD also retain the right to terminate a hire if they feel that any equipment or property belonging to Funbooth LTD is in danger of being damaged or has been damaged due to unruly behaviour from you, event guests or attendees. We also reserve the right to refuse guests or attendees participation in activities if we feel they are too unruly.

In any instances where Funbooth LTD feel there is a need to terminate the hire we will attempt to speak with you or the hosting venue first, if possible, to try and resolve the matter before termination.

You will be fully responsible for any damage or loss caused by you or any event guest or attendee at the event to any equipment howsoever caused, with the sole exclusion of Funbooth LTD staff,

In the event of any damages caused by those present to property or equipment in use by Funbooth LTD, you will be charged the full replacement cost and are liable to costs involved in the termination of future events due to sourcing replacements.

Any damages must be reported to a member of Funbooth LTD staff immediately.

6 Copyright

Photos of our products may be taken at the events that Funbooth LTD attend for promotional purposes. Our staff will only take photos of our items and services, with or without the guests using the products. If you would not like images of your event to appear on our website please advise the member of staff attending the event on site or contact Funbooth LTD to request that the photos not be shown on our website or social media feeds.

If you wish to have a copy of the photos we have taken at your event for personal use (strictly not for business use) then contact us and we will send you copies by email.

7 Complaints

We fully anticipate that you will be delighted with our services, but if you have any complaints, in the first instance you should raise them with us in writing via email to book@funbooth.uk.com within 21 days of the date of your event in order for our complaints procedure to be processed. Funbooth LTD shall try to resolve any disputes with you quickly and efficiently.​

If Funbooth LTD cannot resolve a dispute using our internal complaint handling procedure and either of us want to take court proceedings, the relevant courts of England and Wales will have exclusive jurisdiction in relation to this contract and the laws of England and Wales will apply to this contract.​

In the event of a dispute between us, you and we agree not to engage in any conduct or communications, including on social media, designed to disparage either party or Funbooth LTD’s products and services.

It is your responsibility to check all information in the booking is correct and confirm this with Funbooth LTD. Any error relating to time and/or date resulting in cancellation of service is not Funbooth LTD’s responsibility to rectify.

8 Data Protection / GDPR Notice

Effective date: May 17, 2018

We are fully GDPR compliant and as such when you email us or submit an enquiry/booking to us you acknowledge and provide your consent to our storage and use of your personal data only for the use to administer your email or enquiry/booking. We will remove all data upon request as required by GDPR. We will always treat your personal details with the utmost care and will never sell them to other companies for marketing purposes. To be notified of the data we hold for you or request its removal please contact us.

We use a third party company ‘BoothBook’ to handle our bookings and customer contact.

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our service and the choices you have associated with that data.
